When Phil Cannella asked if the SEC is a reactive organization or a proactive organization when it comes to their attempts to prevent corruption within the securities industry, Kotz first answers by saying that the SEC tries to be proactive by making efforts to meet and talk about emerging technologies and issues.
The more revealing part of his answer, however, came when he went on to admit to Phil Cannella that the fraudsters always seem to be ahead of the government. Somehow, fraudsters and companies that engage in wrongdoing always have more resources and more technology than the Securities and Exchange Commission.
